Form 16 Explained: What It Is, How to Check It and What Changes with Form 130 (2026)

October 21, 2026

Your employer’s HR sends a PDF called Form 16 and tells you to use it for your tax return. Most people open it, see a wall of numbers, and either file blindly or wait for someone to explain it. That is how wrong figures end up in returns. This guide explains what Form 16 is, what each part shows, how to check it in a few minutes, and what changes now that the new Income-tax Act has renamed it Form 130.

Quick Answer

  • Form 16 is the certificate your employer gives you every year showing your salary, the tax deducted at source (TDS) and the tax it deposited with the government in your name.
  • It has two parts. Part A is the TDS record. Part B is the salary and tax calculation.
  • Employers have to issue it by 15 June after the financial year ends. The one you hold now is for FY 2025-26.
  • From 1 April 2026 the salary TDS certificate is called Form 130, so your next one (for tax year 2026-27) will carry that name.
  • You can file your return without it, but you should always check it against your tax credit statement on the e-filing portal first.

What Form 16 Actually Shows

PartWhat is in it
Part AEmployer’s name, address and TAN, your PAN, the period you worked, and the TDS deducted and deposited quarter by quarter with the challan details. This part is generated from the employer’s TDS returns on the TRACES system.
Part BYour gross salary and its breakup, exemptions such as HRA, the standard deduction, deductions you declared, your taxable income, the tax on it and the TDS actually cut.

Think of Part A as proof that tax was paid on your behalf, and Part B as your employer’s working of how much tax you should owe. Your return has to agree with both.

7 Things to Check Before You File

  1. Name and PAN. They must match your PAN card exactly. A wrong PAN means the TDS is credited to someone else’s record.
  2. Employer TAN and period. Check the period covers every month you worked for that employer.
  3. Gross salary. Add up your twelve payslips and compare. If you changed jobs mid-year, make sure the previous employer’s salary was not dropped.
  4. TDS in Part A against your tax credit statement. Log in to the e-filing portal and compare. The TDS on your Form 16 should appear there. If it does not, you cannot claim credit for it.
  5. Deductions. Look for the 80C, 80D and other deductions you gave proofs for. If one is missing, you can still claim it in your return, but keep the proof.
  6. Tax regime. Check which regime your employer applied. The new regime is the default unless you opted out, and you can choose again when you file.
  7. Other income. Form 16 only covers salary. Bank interest, dividends, rent and capital gains are not in it, and they still have to go in your return. Your Annual Information Statement on the portal lists most of them.

If the Numbers Do Not Match

  • Salary or deduction differs from your records: ask HR to explain. It is often a late reimbursement or a proof submitted after the cut-off.
  • TDS on Form 16 is not in the portal: the employer may not have deposited it or filed its TDS return correctly. Ask them to check and file a correction statement. Until it shows, you cannot claim it.
  • Wrong PAN or name: the employer has to correct it and file a revised TDS return.

Do not file on figures you know are wrong and hope it passes. A mismatch can hold up your refund, and if refunds are what worry you, our guide on why an income tax refund gets stuck covers the common causes.

I Have Two Form 16s, or None

Two employers in one year: you will get a Form 16 from each. Add the two salaries together in your return. The TDS from both counts. Check that the second employer’s figures include what you earned at the first, because a missing amount means too little tax was cut and you may owe the difference.

No Form 16: an employer is required to issue it when tax has been deducted, and the Act provides for a penalty if it does not. Ask HR in writing first. Form 16 is not a condition for filing a return, so if it does not come you can use your payslips and the TDS shown on the portal. Keep a note of your request in case you are asked later.

What Changes: Form 16 Becomes Form 130

The Income-tax Act, 2025 replaced the 1961 Act from 1 April 2026. Along with it came a new set of forms and a single “tax year” in place of the financial year and assessment year pair. For salaried people the practical changes are these:

Old formNew formWhat it is
Form 16Form 130Salary TDS certificate from your employer
Form 16AForm 131TDS certificate on non-salary income
Form 12BBForm 124Your investment and deduction declaration to the employer
Forms 16B, 16C, 16D, 16EForm 132TDS certificates on property purchase, rent and similar payments, merged into one form
Form 26ASForm 168The Annual Information Statement on the e-filing portal, showing your TDS, tax paid and reported transactions
  • Nothing changes for the return you file now. Income earned up to 31 March 2026 is still under the old law, so the Form 16 you hold for FY 2025-26 is the right document.
  • Form 130 starts with salary earned from 1 April 2026. Under section 395(4) and Rule 215, the employer issues it by 15 June after the tax year ends, so the first one, for tax year 2026-27, is due by 15 June 2027. It can only be generated from the TRACES system.
  • The layout changes. The department’s FAQ describes Part A (employer and employee details), Part B (a summary of payments against tax deducted) and Part C, Annexure I (the salary working: gross salary, exemptions, deductions, taxable income and tax payable). So the salary calculation you now read in Part B moves to the annexure. If you have more than one employer, each issues Parts A and B for its own period.
  • Your declaration to the employer is now Form 124. When your company asks you for investment proofs, the form carries the new name (section 392(5)(b), Rule 205), but the idea is the same.

Use Form 16 to Plan Next Year

Part B shows exactly how your employer computed your tax, which makes it the best planning document you have. If your take-home was lower than you expected, compare the deductions and the regime it used with what you could have claimed. Our in-hand salary calculator and TDS calculator show how the numbers move.

Before You Rely on This

  • The form names, sections, Rule numbers, structure and due dates for Forms 130, 131, 132 and 124 are from the Income Tax Department’s own form pages and Form 130 FAQ. Form 168 is titled the Annual Information Statement in the department’s form, so in practice you will use the statement on the e-filing portal.
  • The department’s pages do not say in so many words which form applies to FY 2025-26 salary. Published guidance says Form 16 still applies and was due by 15 June 2026. If your employer sent you a Form 130 for that year, ask HR which one they mean.
  • Employers handle Form 16 differently, and portal menus change. Confirm on the e-filing portal or with a chartered accountant if your case is unusual, such as a job change, a foreign income or a large claim.

Frequently Asked Questions

Is Form 16 compulsory to file an ITR?
No. It is the easiest way to get your salary and TDS figures, but you can file using payslips and the TDS shown on the portal.

When will I get my Form 16?
Employers have to issue it by 15 June after the financial year ends. If it is late, ask HR in writing.

Can I download Form 16 myself?
Usually not. The employer generates it from the TRACES system and sends it to you. You can see the matching TDS on the e-filing portal.

Is Form 16 the same as Form 130?
Form 130 is the new name for the salary TDS certificate under the Income-tax Act, 2025. It applies to salary from 1 April 2026, so the form you hold now is still Form 16.

My Form 16 and the portal show different TDS. Which is right?
The portal is what the department credits to you. If your Form 16 shows more, the employer may not have deposited or reported it. Ask them to correct it before you claim the higher amount.
